How Probate Works

Some assets are subject to the probate process in California, while other assets are not. In cases where some of the decedent’s assets are subject to probate, the executor of the decedent’s estate must file the necessary paperwork with the Court to “open probate.” During the probate process, any debts or other liabilities can be satisfied with estate assets.

Some assets, on the other hand, are not subject to the probate process, including the following:

  • Individual Retirement Accounts (IRA’s)
  • Assets which are held as part of a joint tenancy
  • Proceeds of a life insurance policy
  • Assets which are held in trust
  • Assets which have a named beneficiary associated with them
