Anti-Adultery Laws and Anti-Paternity Fraud Law in California

Anti adultery laws making marital infidelity a crime do not exist in California. California has no anti adultery laws that criminalize cheating. The anti paternity fraud law passed framework in California addresses men deceived about biological paternity. Family Code section 7646 provides the anti paternity law pathway to set aside fraudulent paternity judgments within two years of discovering non-paternity, supported by DNA evidence. Anti paternity fraud law passed in California allows courts to relieve men of future child support when paternity was established through fraud, subject to the child's best interests.
